ポンペオ米国務長官記者発表要旨

さきほど（現地時間2020-05-27）、ポンペオ米国務長官は米議会に対して、香港の自治は失われたとする判断を示し、その記者発表が同日付で国務省のウェブサイトで公表されました。

I certified to Congress today that Hong Kong does not continue to warrant treatment under United States laws in the same manner as U.S. laws were applied to Hong Kong before July 1997. No reasonable person can assert today that Hong Kong maintains a high degree of autonomy from China, given facts on the ground.

香港の「特別な地位」の停止？

去年末（2019-12-02）の記事でも紹介したように、香港の特別な地位を認め、さまざまな優遇等の根拠となる米国・香港政策法[2]（以下「法」）Sec 201の効力は、香港における自治等の状況を見て米国大統領が大統領令（Executive order）によっていつでも停止（法201(a)）できると定められています（Fig1）。

今回のポンペオ米国務長官記者発表は、この図のSec.201(a) 効力停止コースに舵が切られたことを意味するのでしょうか。

SEC. 202. PRESIDENTIAL ORDER.
(a) PRESIDENTIAL DETERMINATION– On or after July 1, 1997, whenever the President determines that Hong Kong is not sufficiently autonomous to justify treatment under a particular law of the United States, or any provision thereof, different from that accorded the People’s Republic of China, the President may issue an Executive order suspending the application of section 201(a) to such law or provision of law.
(d) TERMINATION OF SUSPENSION– An Executive order issued under subsection (a) may be terminated by the President with respect to a particular law or provision of law whenever the President determines that Hong Kong has regained sufficient autonomy to justify different treatment under the law or provision of law in question. Notice of any such termination shall be published in the Federal Register.

香港人権法とマーティン証言

「2019年の香港人権・民主主義法」[1]（以下「香港人権法」）の成立過程で米議会図書館調査局・外交防衛通商部のアジア問題専門家であるマイケル・マーティン氏[2]が米国外交問題評議会（CFR）で行った証言[3]（以下「マーティン証言」）を前回紹介しましたが、その内容についてはほとんど触れなかったので、今回はその内容について簡単に紹介したいと思います。

香港人権法の立法過程とマーティン証言

2019年11月27日に成立した「2019年の香港人権・民主主義法」[1]（以下「香港人権法」）には「1992年の米国-香港政策法」[2]（以下「政策法」）の改正条文（香港人権法 Sec.4）が入っています。

どのような過程で改正条文が入ったのか、改正内容はどのようなものか、簡単に確認したいと思います。

立法過程

香港人権法はTable 1に示す日程で成立しました[3]。同法案が上院に提出されてから167日で成立したことになります。

09年26日の外交問題評議会（CFR）おけるジム・リッシュ上院議員[4]の報告は現時点では正式に公開文書化されていないようですが、米議会図書館調査局・外交防衛通商部のアジア問題専門家であるマイケル・マーティン氏[5]によるCFR東アジア・太平洋・国際サイバーセキュリティ政策小委員会ヒアリングでの同日付の証言資料『香港緊急事態：自由、自治及び人権の保護』[6]（以下「マーティン証言」）が米国議会図書館調査局（CRS）のウェブページで公開されています。

マーティン証言

マーティン証言は全体としても相当気合が入っており、資料の最後のページ（p.7）で、「香港人権法によって政策法を改正し、香港の自治等の状況についての年次報告書を国務大臣が作成することで…」（以下引用自粛）と結論しています。

香港人権法 Sec.4

政策法にはそもそも年次報告書に関する条文（Sec.301. 報告書）が入っていましたが、今回成立した香港人権法（Sec.4）によって政策法にはさらに Sec. 205（Secretary of State Report Regarding the Autonomy of Hong Kong）及び 206（Treatment of Hong Kong Applicants for Visas to Study or Work in The United States）が追加されました（Table 2）。

これらのうち、Sec. 205 は、旧法が定める①米国輸出管理法及び②国連制裁決議に係る内容に加え、③香港における自治の状況や④修学ビザ及び就労ビザの取扱—についての報告を新たに付け加えています。

SEC. 205. 香港の自治に係る国務省報告書
SECRETARY OF STATE REPORT REGARDING THE AUTONOMY OF HONG KONG.
(a) 検定—
Certification.—
(1) 総則 — subsection (b)に定める場合を除き、section 301の定める報告義務と相まって、国務長官は少なくとも年に1回、次の各号の項目について議会に報告しなけれはならない。
IN GENERAL.—Except as provided in subsection (b), the Secretary of State, on at least an annual basis, and in conjunction with the report required under section 301, shall issue a certification to Congress that—
- (A) 香港は、1997年07月01日以前に米国法が香港に適用されていたのと同様に、引き続き米国法の適用を保証しているか;
  indicates whether Hong Kong continues to warrant treatment under United States law in the same manner as United States laws were applied to Hong Kong before July 1, 1997;

    law enforcement cooperation, including extradition requests;

    export controls, and any other agreements and forms of exchange involving dual use, critical, or other sensitive technologies;

  - (vi) その他、国務長官が対象とすべきと判断する二国間協力に係る分野;
    other areas of bilateral cooperation that the Secretary determines to be relevant; and
  - (vii) 次の各号に係る、行政、立法及び司法構造についての香港政府の意思決定—
    decision-making within the Government of Hong Kong, including executive, legislative, and judicial structures, including—
    - (I) 結社の自由;
      freedom of assembly;
    - (II) 言論の自由;
      freedom of speech;
    - (III) 表現の自由; 及び
      freedom of expression; and
    - (IV) インターネット及びソーシャル・メディアを含む出版の自由;
      freedom of the press, including the Internet and social media;
  - (viii) 最終的には香港特別行政区行政長官及び香港特別行政区立法会の議員の普通選挙を含む普通選挙の実施;
    universal suffrage, including the ultimate aim of the selection of the Chief Executive and all members of the Legislative Council by universal suffrage;
  - (ix) 司法の独立;
    judicial independence;
  - (x) 警察及び公安の機能;
    police and security functions;
  - (xi) 教育;
    education;
  - (xii) 反逆、独立、扇動、中国中央政府転覆又は国家秘密窃取に係る法律または規則;
    laws or regulations regarding treason, secession, sedition, subversion against the Central People’s Government of the People’s Republic of China, or theft of state secrets;
  - (xiii) 外国政治組織又は団体に係る法律または規則;
    laws or regulations regarding foreign political organizations or bodies;
  - (xiv) 政治組織に係る法律または規則; 及び
    laws or regulations regarding political organizations; and
  - (xv) 1948年12月19日にパリにおいて採択された世界人権宣言及び1966年12月19日にニューヨークにおいて採択された市民的及び政治的権利に関する国際規約に列挙されている諸権利; 並びに
    other rights enumerated in the Universal Declaration of Human Rights, done at Paris December 10, 1948, and the International Covenant on Civil and Political Rights, done at New York December 19, 1966; and
- (C) 以下の各号を含む—;
  includes—
  - (i) 基本法又は共同宣言に反する中国政府の行為によってもたらされる、香港おける自治の腐敗に係るsubparagraph(B)に列挙する各カテゴリーについての腐敗の程度の検証;
    an assessment of the degree of any erosions to Hong Kong’s autonomy in each category listed in subparagraph (B) resulting from actions by the Government of the People’s Republic of China that are inconsistent with its commitments under the Basic Law or the Joint Declaration;
  - (ii) 香港の自治の腐敗又はsubparagraph (B)が定める米-香港間の国際合意に基づく義務を香港政府が履行できなかったことに起因するすべての分野における米-香港協力に与える具体的影響の評価; 及び
    an evaluation of the specific impacts to any areas of cooperation between the United States and Hong Kong resulting from erosions of autonomy in Hong Kong or failures of the Government of Hong Kong to fulfill obligations to the United States under international agreements within the categories listed in subparagraph (B); and
  - (iii) 本検証によって特定された自治の腐敗並びに本検証により特定された、国際合意及びSection 301が定める報告書により基づく米国への義務の不履行に対して米国政府が行った具体的対応のリスト;
    a list of any specific actions taken by the United States Government in response to any erosion of autonomy or failures to fulfill obligations to the United States under international agreements identified in this certification and the report required under section 301.
(2) 検討事項—paragraph (1)に定める各検証を行うにあたっては、国務長官は、条件、義務及び香港に係る共同宣言で表明された期待を考慮しなけれはならない。;
FACTOR FOR CONSIDERATION.—In making each certification under paragraph (1), the Secretary of State should consider the terms, obligations, and expectations expressed in the Joint Declaration with respect to Hong Kong.
(3) 追加的検証—section (1)に定める検証は毎年行われなければならない。但し、香港の状況に照らして国務大臣が必要と認めるときは、いつでも追加的検証を行うことができる。
ADDITIONAL CERTIFICATIONS.—The certification under section (1) shall be issued annually, but the Secretary may issue additional certifications at any time if the Secretary determines it is warranted by circumstances in Hong Kong.
(b) 免除措置—;
Waiver Authority.—
(1) 総則—以下の各号が定める場合には、国務長官は、subsection (a)の適用を免除することができる—
IN GENERAL.—The Secretary of State may waive the application of subsection (a) if—
- (A) 当該免除措置が米国の国家安全保障上の利益に私すると判断したとき; 及び
  the Secretary determines that such a waiver is in the national security interests of the United States; and
- (B) 当該免除措置が発行する日及びそれ以前の日において、国務長官が上院外交問題評議会及び米下院外交委員会に同subsectionの適用免除を通知したとき;
  on or before the date on which the waiver takes effect, the Secretary notifies the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives of the intent to waive such subsection;
(2) 一部免除措置—subsection (a)(1)(C)(iii)の定めるリストに掲げる場合を除き、米国法が定める香港に対するいかなる特定の措置も保留することができる旨を定めたsection 202の大統領令を大統領が発した場合は、国務長官はsubsection (a)の定める措置のうち適切な部分を免除することができる。;

香港人権法案成立

2019年11月27日香港人権法案にトランプ大統領が署名

11月27日に「2019年の香港人権・民主主義法案」[1]にトランプ大統領が署名し[2]、同法（以下「香港人権法」）が成立しました。

香港人権法は、インド太平洋戦略（ FOIP, AOIP ）にも大きく関係してくる法律なので、まずは同法の周辺を確認してみたいと思います。

香港人権法の章構成を Table 1 に示します。今回の件で中国はブチ切れているわけですが、どのあたりが中国の逆鱗に触れたのか？

機会を改めてきちんと条文を見てみたいと思っていますが、Sec.7, 9 あたりが「ヤバイ」感じですね。

なお、米国が香港状況について毎年レポートを作成することに対して中国政府が内政干渉だとして強烈に反発して対抗措置という報道もありますが、この仕組みそのものは以下で紹介する「1992年の米国-香港政策法」で既に定められていることがらなので、いまさら本当かな？という気はします。

立法の背景

香港人権法は「1992年の米国-香港政策法」（以下「香港政策法」）[3]の改正法として成立したものです。

香港政策法301条（Reporting Requirement: 報告義務）は、「国務長官は下院議長及び上院外交関係委員会に対して米国の利益に係る香港の状況について報告しなければならない」と定めています。

その報告書の最新版である「2019年版・香港政策法報告書」[4]がネットで公開されているので、ちょっと見てみました。

香港人権法の成立にはこの報告書が一定の役割りを果たしているわけですが、どのような内容だったのでしょうか。

2019年版・香港政策法報告書

根拠法

上述のように、香港政策法報告書（以下「報告書」）は香港政策法301条に基づいて作成されます。

法201条（Continued Application of United States Law: 米国法の適用継続）は、 1997年07月01の香港返還後も、米国が香港に認めているさまざまな優遇措置など（最恵国待遇などの「特別な地位」）に係る米国法が引き続き適用されていることを定めています。

しかし、優遇等の根拠となる法201(a)の効力は、香港における自治等の状況を見て、米国大統領が大統領令（Executive order）によっていつでも停止(201(a))及び停止解除(201(d))できます（Fig 1）[3]。

したがって、報告書はそのための重要な資料ということになります。

2019年版の報告書は「主要な結論」（Key Findings）を以下の3項目にまとめています（Table 2）。

米国は、以前と変わることなく深く経済的及び文化的利益を香港に有する。米国政府及び香港政府の協力は様々な分野において今後も広範かつ効果的に行われ、米国に経済上及び安全保障上の重要な利益をもたらす。
本報告書の対象期間(*1)において、中国本土中央政府は、香港の高度の自治を認めている基本法(*2)や1984年の英中共同宣言(*3)に反すると見られる行為・煽動を数多く行っている。香港問題及び香港政府の合法的な施策に対する本土中央政府の干渉のテンポは増加しており、直近において負のトレンドが加速している。
一般的には、程度は後退したものの、二国間合意に基づいて米国が（香港に対する）優遇措置を維持することを正当化するのに十分な程度には「一国二制度」の枠組み下での自治が維持されている。

インド太平洋戦略成立の経緯

インド太平洋構想の経緯については複数の見方があるようですが、Lavina (2016)[1]は、2012年に安倍首相が Project Syndicate[2]に寄稿した Asia’s Democratic Security Diamond [3] がそもそもの端緒だとしています。

この構想 — 日米豪印でかたちづくるいわゆる「セキュリティダイヤモンド構想」が、米国のFOIP （Free and Open Indo- Pacific）に発展し、ASEANのAOIP （Asean Outlook on Indo-Pacific）として結実したとする説です。ざっと調べたところ、異説が無いわけではありませんが、本説がほぼ通説だと考えて良さそうです・

当時の国際枠組み

アジア太平洋（日米豪）の枠組みにインド（印）を加えるアイディアについて当時の議論を探してみたところ、三井物産戦略研究所の新谷氏が2014年にとてもわかりやすい論文を公表していらっしゃいました[4]。同論文には、「アジアにおける地域協力ネットワーク」と題して、ASEAN（さらにプラス3、プラス6 = RCEP）、APEC、TPP、SAARC（南アジア地域協力連合）、IORA（環インド洋連合）の見取り図（Fig 1）が丁寧に解説されています。基礎知識としてこの図は頭に入れておいて損は無いでしょう(*)。

なお、ネットワークの構成メンバー国・地域にはその後変動がありましたので、2019-11-26時点の情報でアップデートしました(*)（Fig 2）。
